Interiors By Sutton is a trading style of Interiors By Sutton Ltd (referred to as "Interiorsbysutton.com /we/our/us"). As a user of this website (referred to as "you/your"), you understand that your use of this website, including any transactions you make, is governed by the Terms and Conditions set forth below.

1. General

 

1.1 These Terms & Conditions are subject to change at any time. It is your obligation to read the Terms and Conditions each time you visit this website, and your continuous use of the website signifies your acceptance of the most recent Terms and Conditions.
 

1.2 If you are not a consumer, you accept these terms that you have the ability to bind any business on whose behalf you use this website.
 

1.3 Certain internet features will need registration, and subsequent access to those services will be restricted to a user name and password that have been approved ("Password Details"). You must submit correct and complete information on this website. All Password Details are accepted, but we reserve the right to remove them at any time. They are personal to you, non-transferable, and must be kept completely private at all times. You must notify us promptly if you have any concerns about your Password Details or become aware of any misuse.

1.4 All pricing, discounts, and promotions offered by Interiors by Sutton are exclusive to our online website and are not applicable in-store or through any other channel unless expressly stated otherwise.

 

2. Order Process

 

2.1 All orders placed with Interiors By Sutton are subject to approval in accordance with the following Terms & Conditions.
 

2.2 The final details of your order are laid forth in the 'confirmation' stage. Following that, we'll send you an order confirmation email with a list of the items you've ordered. This email does not constitute an order confirmation or acceptance from us. We will check the necessary information, such as stock levels and pricing, once we receive your order.
 

2.3 Unless we have advised you that we are unable to accept your purchase or you have cancelled it, we shall accept your order and complete the contract between you and us when we send the products ordered.

2.4 By placing an order for carpets, you acknowledge and agree to adhere to a minimum order length of 2 meters, as specified by the width of the selected item. It is expressly understood that orders failing to meet this minimum length requirement will not be fulfilled. Furthermore, we shall not be held liable for any glitches or computer-related problems affecting the order fulfillment process, provided that such issues arise due to technical malfunctions or system errors. In such cases, where the minimum order length requirement is not met due to computer glitches, a refund will be issued to the customer. This clause serves as a binding agreement between the you and us, outlining the terms and conditions governing carpet orders and acknowledging the exemption of liability for computer-related issues impacting order fulfillment.

 

3. Delivery

 

3.1 This website's 'Free Delivery' service is only available to customers with mainland UK addresses who are not in the Grampian or Highland districts. There will be an extra cost for orders sent to Highland or Grampian districts. We can deliver to the Channel Islands, Isle of Man, Orkney, Shetland, and Scottish Islands, however there will be an additional delivery charge. At the time of delivery, all goods must be signed for by an adult aged 18 or older. We do not deliver to Northern Ireland or Ireland.
 

3.2 The Delivery Information section specifies delivery rates and projected delivery times. We make every effort to deliver goods on time, but delays are sometimes unavoidable due to unforeseen circumstances, and deliveries of multiple items may come on various days or on several deliveries. Any delay or inability to deliver the products within the estimated timeframes is not our responsibility.
 

3.3 The risk of product loss and damage falls to you on the date that the products are delivered or when we attempt the first delivery.
 

3.4 Your package will be delivered to the curbside of your address. On request, some drivers will deliver products to your front door or into your property, but this is at their discretion, and we cannot guarantee that they will. We cannot be held responsible for any damage caused by objects brought into the property.

3.5 Please notice that Interiors By Sutton strongly urges you to wait until you have received and checked your order before booking your fitter or landscaper, as we are not responsible for any installation expenses or lost pay.

3.6 Please keep in mind that an item being delivered may be heavier than the driver can lift in some cases. In these cases, it is the customer's responsibility to ensure that they have enough equipment and personnel on hand at the time of delivery to assist with vehicle unloading, or that they can provide smaller cut down sizes for the product ordered that can be delivered to the curbside and unloaded without assistance.

3.7 Bespoke items, such as stair runners requiring specialised edging, are anticipated to necessitate a span of approximately 14 to 21 working days (excluding weekends) for completion. These timeframes, while presented as estimates, are subject to the inherent variability of the manufacturing process and, as such, cannot be definitively assured. The intricate cutting and stitching involved in crafting these bespoke items are directly overseen by the manufacturer, thereby influencing the production timeline. It's important to acknowledge that this estimated duration extends to all other bespoke offerings accessible through our website. Our commitment remains steadfast in providing accurate forecasts, although the intricacies of the manufacturing process may introduce occasional deviations.

 

4. Payment

 

4.1 We charge your card or PayPal account after we receive your order, after we've verified the order value and card or PayPal information. Availability of goods is subject to change. If we are unable to fulfil the goods you have requested, we will notify you as soon as possible. If you decide to cancel at this time, you will receive a full refund if you have already paid for the goods. Additional PayPal payment terms and conditions can be found at www.paypal.co.uk.
 

4.2 We will authenticate your name, address, and other personal information submitted by you throughout the order process against suitable third-party databases to ensure that your credit, debit, charge card, or PayPal account is not being used without your authorization. You consent to such checks by accepting these Terms & Conditions. Personal information submitted by you may be disclosed to a registered Credit Reference Agency as part of these checks, and that information may be kept on file. You may rest certain that this is simply done to authenticate your identity and that your credit rating will not be affected. All information you supply will be treated with care and adherence to the Data Protection Act 1998.
 

4.3 The price you pay is the price listed on the product page of this website at the time we receive your order for your specified size(s). While we make every effort to guarantee that all prices on our website are correct, mistakes do happen. If we discover an error in the pricing of items you've ordered, we'll let you know as quickly as possible and give you the choice of reconfirming or cancelling your order at the correct price. If we are unable to contact you, your order will be cancelled. You will receive a full refund if you cancel and have already paid for the goods.
 

4.4 Payment can be made by PayPal or debit/ credit cards.
 

4.5 If we have processed and received full payment for any products you order from Interiors By Sutton, ownership of such products will pass to you upon delivery.
 

4.6 Unless otherwise noted, all prices are in GBP sterling and include VAT (where applicable) at current rates as well as regular delivery charges.
 

4.7 If an agreement has been established between Interiors By Sutton and the user, which includes a requirement for a deposit to be paid for an order, it is mandatory that the full payment for the ordered product(s) is settled prior to the scheduled delivery date. In cases where the scope of work involves any form of fitting or installation, the amount allocated for fitting services can be retained and provided directly to the designated fitter after completion of fitting/installation in the form of a cash payment.It is important to note that Interiors By Sutton holds no responsibility for the contractual agreements between the user and the appointed fitter. The fitters engaged for such services are self-employed entities and their association with Interiors By Sutton is solely for recommendation purposes. Should the user choose to accept and engage the services of the recommended fitter, any matters related to fitting issues must be communicated directly between the user and the fitter. Interiors By Sutton is not accountable for any aspects of the arrangement or agreement between the user and the fitter, beyond the initial recommendation.

 

5. Returns, Cancellations and Substitutions

 

 

5.1 When ordering from Interiors By Sutton online or over the phone, you have the option to cancel and return your order within 14 days of receiving it. Some products are exempt from this guideline, such as carpets, rugs, and runners that are cut to your exact specifications. Please keep in mind that you will be responsible for organising and paying for the return of the item(s). You must return all things in the same packing and condition as you received them.

5.2 Please inform us before assembling any furniture item(s) or cutting and/or fitting any wallpaper(s), carpet(s), rug(s), or runner(s) in the odd event that you receive faulty or damaged product(s), and we will arrange for the faulty or damaged goods to be retrieved and replaced. Unfortunately, we will not be able to replace or refund any ordered item(s) that have been taken from their original condition (for example, furniture that has been assembled or wallpaper(s), carpet(s), rug(s), or runner(s) that have been cut and fitted).

5.3 In the event that the manufacturer's product specs change, we will try our utmost to provide you with a comparable replacement. We may encounter supply issues with specific products and consequently provide a comparable or better option at the same price. If you are not satisfied with the replacement or substitution, you may return it within 30 days for a refund. Where relevant, you have the right to cancel your order under the Distance Selling Regulations.

5.4 For collections, we request that the item be neatly wrapped and ready for transit; if more packaging is required, we may provide it. If the collected item is heavy, the driver may need assistance loading it from the nearest kerbside of the home. The collection may not be performed if the item is not wrapped or you are unable to carry it out to the curbside at the time of collection.

5.5 To start a return, you can contact us at support@interiorsbysutton.com. Please note that returns will need to be sent to the following address: 412 Birmingham Road, Wylde Green, Sutton Coldfield, B72 1YJ. - Unfortunately, we cannot accept returns on clearance or sale items.

5.6 Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. As above, your item must be in the same condition that you received it, unopened, unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

5.7 We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days excluding any delivery fees paid unless stated otherwise. Please remember it can take some time for your bank or credit card company to process and post the refund too. If more than 15 business days have passed since we’ve approved your return, please contact us at support@interiorsbysutton.com.

 

6. Intellectual Property

 

6.1 You understand and agree that we and our licensors retain all copyright, trademarks, and other intellectual property rights in all materials and/or content made available as part of your use of our website. You may only use this material if we or our licensors have expressly authorised it.
 

6.2 You understand and agree that the material and content on this website are provided solely for your personal, non-commercial use, and that you may only download such material and content for the purpose of using this website. You also acknowledge that any other use of the material and content on this website is strictly prohibited, and you agree not to copy, reproduce, transmit, publish, display, distribute, commercially exploit, or create derivative works of such material and content (and you also agree not to assist or facilitate any third party in doing so).

 

7. Liability and Indemnity

 

7.1 Nothing in these Terms and Conditions limits or excludes liability for death or personal damage caused by negligence, fraud, or any other liability that cannot be restricted or excluded under applicable law.
 

7.2 We will use reasonable efforts to verify the accuracy of any information on the site, subject to Section 7.1 above, but we make no representation or warranty of any kind, express or implied, statutory or otherwise, regarding the site's contents or availability, or that it will be timely or error-free, We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website, and we accept no liability of any kind for any loss, damage, or reliance on material or information contained on the site.
 

7.3 Except as expressly provided in these Terms and Conditions with respect to specific products and except for the exclusive remedies set out in Section 5 above, any indemnities, warranties, Terms and Conditions (whether express or implied) are hereby excluded to the fullest extent permitted by applicable law, subject to Section 7.1 above.
 

7.4 Subject to Section 7.1 above, we will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the Terms and Conditions for any:

 

(a) Economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings).
(b) Loss of goodwill or reputation.
(c) Special or indirect losses.
(d) Injuries suffered or incurred by that party arising out of, or in connection with the provisions of any matter under these Terms and Conditions.

 

7.5 Regardless of the foregoing, our total liability for loss or damage (whether in contract, tort, or otherwise) shall in any event be limited to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same cause, subject to Section 7.1.
 

7.6 Clause 7 has no bearing on your statutory rights as a consumer or your right to cancel a contract.
 

7.7 We will take all reasonable precautions to keep the details of your order and payment secure, but we will not be liable for any losses resulting from unauthorised access to information provided by you unless we are negligent.

 

8. Miscellaneous Provisions

 

8.1 The contract between us will be governed by English law, and any dispute between us will be resolved solely through English courts. For the contract's conclusion, English is the only language available.
 

8.2 We've chosen our items with the assumption that they'll be used for home use only (exceptions apply and are clearly indicated as suitable for contract/commercial use), so if you're planning to use them for business, make sure you're covered. We exclude (to the maximum extent permissible by law) any warranties and conditions relating to fitness for a particular purpose if you decide to use the items in the course of your business. Our maximum responsibility to business users arising from or in connection with the products is limited to the product's replacement value (except in the case of death or personal injury caused by our negligence or in respect of fraud). In the case of a claim for breach of warranty or condition, we do not accept liability for the fitness of products for business purposes, nor do we accept liability for loss of use or any loss in excess of the item's cost.
 

8.3 We will not be liable for any delay or failure to deliver products or otherwise execute any obligation under these Terms and Conditions if the delay or failure is caused entirely or partially by circumstances beyond our reasonable control, whether directly or indirectly.
 

8.4 We may provide connections to other websites or resources for you to access at your own discretion in order to bring further value to our customers. You understand and accept that, because you choose to visit the linked websites, we are not responsible for their availability, and we do not review or endorse, and are not responsible or accountable (directly or indirectly) for:
 

(i) The privacy practices of such websites. 
(ii) The content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources.
(iii) For any damage, loss, or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods, or other materials or services available on such external websites or resources, nor for any damage, loss, or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods, or other materials or services available on such external websites or resources.
 

8.5 You may not delegate or subcontract any of your rights or duties under these Terms and Conditions or any connected product order to any third party unless Interiorsbysutton.com agrees in writing.
 

8.6 We reserve the right to transfer, assign, or subcontract the benefit of any of our rights or duties under these Terms and Conditions or any linked contract to a third party in whole or in part.
 

8.7 If any part of these Terms and Conditions is found to be invalid or unenforceable in whole or in part by a competent authority, the validity and enforceability of the remaining sections of these Terms and Conditions will not be impacted.
 

8.8 These Terms and Conditions do not create or confer any rights or benefits enforceable by a third party (as defined under the UK Contracts (Rights of Third Parties) Act 1999).
 

8.9 These Terms and Conditions, including any documents or other sources referred to in these Terms and Conditions, supersede all prior representations, understandings, and agreements between you and Interiorsbysutton.com relating to the use of this website (including product ordering) and set forth the entire agreement and understanding between you and Interiorsbysutton.com for your use of this website.

 

9. Carpet, Rug, Runner & Flooring Specific Conditions of Sale

 

9.1 Remove all packaging and thoroughly inspect the ordered item(s) before booking your flooring fitter to confirm they are of the quality, size, pattern, and colour you expected, and are free of damage and/or flaws. You are the owner of the item once you have cut into and/or fitted it, and Interiorsbysutton.com cannot be held liable for any exchanges or fitting fees.

 

(a) Staples or sharp items can be found in packaging and on the product itself. Before fastening the item(s) for everyday use, please ensure that you or your fitter have completely checked the product for such things and carefully removed all such packaging. Interiors By Sutton is not responsible for any accidents that occur as a result of items being installed without being thoroughly checked for sharp objects before or during the installation process.

 

9.2 Please keep in mind that we cannot guarantee an identical colour match between rolls. If an exact colour match is necessary, please let us know when placing your order and we will do everything we can to assist. When different widths are selected or the flooring is ordered on separate dates, a precise colour match is very difficult to achieve.
 

9.3 After some time in use, all pile carpets, rugs, and runners, particularly plain grounds, are prone to shading, i.e. showing bright and dark patched areas. This is due to stepping unevenly pressing the surface. Light and finely shaded carpets are prone to become soiled with use, and the colours may appear to fade. Because both tendencies are inherent in all pile materials, we cannot be held liable for any complaints resulting from either of these causes.
 

9.4 All dimensions are in accordance with British Standards 3655 (1974) +/- 1.25% in width and/or length.
 

9.5 Although every attempt is taken to deliver items on time, this service cannot be guaranteed. As a result of the late or early delivery, we are unable to provide compensation. Any information provided about expected delivery times or dates is provided in good faith.
